Who these terms are between
These terms are an agreement between you and AIVID, LLC, a company in the United States that runs Creatide AI (“we”, “us”). Our address is 131 Continental Dr, Suite 305, Newark, DE 19713, USA. They cover the Creatide AI affiliate program. They sit on top of our Terms of Service. For affiliate matters, these terms win if the two differ.
You are an independent contractor. You are not our employee, agent, partner or joint venturer. You choose how and where you share your link. You pay your own costs and your own taxes. You cannot make promises or sign anything on our behalf.
Every Creatide account can earn as an affiliate. There is no application. You accept these terms once, with a checkbox, before your first conversion to credits, your first payout account setup or your first withdrawal. If you share your link before that, these terms already apply to what you do.
Sometimes a new version needs your acceptance again. Then we ask you again, and until you accept, conversions, payout account setup and withdrawals stay closed. Your link keeps working and you keep earning.
An account that is banned, or blocked by a sanctions check, cannot earn.
Your link and your customers
You get one affiliate code. We make it for you and it does not change. Add ?r= and your code to the end of the address of any Creatide page, and that is your link. If the address already has a question mark, use &r= instead. Your dashboard shows your code and a ready link.
A person counts as your customer when all of this is true:
- they click your link;
- they create a Creatide account on the same device within 60 days of that click;
- your click is the most recent affiliate link click on that device before they sign up.
The match is fixed when they sign up. A later click on another affiliate’s link does not change it, and a click after sign-up does not count.
You cannot be your own customer. A sign-up from your own devices, or from an account you control, is not matched to you.
We can cancel a match that breaks these terms. A cancelled match earns nothing from then on, and commission that is still in the 30-day wait is reversed.
A promo code and an affiliate link cannot be used together. Checkout does not take a promo code from a customer who came through your link, and a payment made with a promo code earns no commission.
What you earn
You earn a percentage of what your customer pays for a plan or a credit pack. The percentage is a rate set for each price. Each plan, each billing period and each credit pack has its own rate. A subscription has one rate for its first payment and one for renewals. A credit pack has one rate.
These terms do not state rates. The rate for each payment is the rate we have set for it. We can change rates at any time, including for future payments from customers you have already referred. A change never affects commission already earned. The affiliate page describes the program.
Commission is worked out on the amount the customer actually paid, so a limited-time offer price pays on the discounted amount. A failed or unpaid invoice earns nothing.
A price that has no rate set earns no commission.
The 12-month window
Each customer has a window. It starts with their first payment to Creatide of any kind, even a payment that earns no commission.
For 12 months (365 days) from that first payment, you are paid on first payments, renewals, new subscriptions and credit packs. After 12 months, nothing the customer pays earns commission, even if they keep subscribing. They are no longer your customer for the program.
A yearly plan pays once in practice. Its second payment comes after the window has closed.
Second and later subscriptions
A customer can have more than one subscription. The first subscription they pay for earns the rate we have set for it, on all its invoices: the first payment and every renewal.
Their second and later subscriptions earn commission at a lower rate than the rate we have set for each of them, on every invoice. We do not state the lower rate here, and it is never below zero.
Subscriptions are ordered by when they started, not by when we process their invoices. A subscription that never collected any money, such as a free first month that ended without a payment, does not count as the first. A subscription that was paid and later refunded or lost in a dispute still counts. It does not matter whether the first subscription is active or cancelled.
Credit packs are never reduced.
The 30-day wait
A new commission is Pending. It becomes Available 30 days after the customer’s payment. You can convert or withdraw only what is Available.
We write a commission only for a payment that was actually paid.
Refunds and disputes
If a customer is refunded, or disputes a payment with their bank or card issuer, we reverse the commission for that payment. A partial refund takes back a proportional share. We do this even when the commission is already Available, and even when you have already converted or withdrawn it.
If a dispute is later won, we put the commission back.
If a dispute is stopped by the card networks’ prevention system, or closed as a warning only, we take nothing back.
We take back only the commission. The fees that Stripe or banks charge us for a dispute stay with us.
If we make a mistake in a calculation, we fix it with a correcting entry. Your history shows it, with the reason.
Negative balance
A reversal can come after you converted or withdrew the money. Then your balance goes below zero.
Your later earnings cover a negative balance first. While your balance is below zero, you cannot convert or withdraw.
A fee adjustment can also take your balance below zero, when the final payout fee is higher than the estimate. See “Payout fees and returned payouts”.
We do not collect a negative balance from you. We do not charge you, and we do not collect it in any other way. If you do not earn enough to cover it, we bear the loss.
A payout that the bank sends back can also take your balance below zero, because of the payout fee and its fee adjustment. See “Payout fees and returned payouts”.
Converting to Creatide credits
You can turn Available money into Creatide credits. Once the conditions below are met, it happens at once.
A conversion goes one way. Credits never turn back into cash. Credits do not expire.
The number of credits you get for each $1 is shown on the convert screen before you confirm. We can change it. A change only applies to later conversions.
Converting needs no tax form. The conditions are that you have accepted these terms, given the details described under “Identity and sanctions checks”, and that your sanctions check is clear.
Cash withdrawals
We pay cash to a bank account only, through Stripe. You set up the account in a form that Stripe hosts. We do not pay by PayPal or crypto.
The smallest withdrawal is $100.
To withdraw cash, all of these must be true:
- you have accepted these terms;
- you have given your legal name and date of birth;
- you have a valid tax form;
- you are in a country where we pay cash;
- your balance is not below zero;
- your sanctions check is clear.
Before we send it, we review your first withdrawal and any withdrawal over $1,000 by hand. We can hold or refuse a withdrawal that we cannot check.
Before we send a withdrawal, we check these conditions again. If one fails, the withdrawal goes back to review. Your bank decides when the money arrives. Only one withdrawal can be in progress at a time.
A withdrawal that we refuse, or that fails, goes back to your balance in full.
The country of your payout account must match the country of your tax form. If you move, ask Support.
Payout fees and returned payouts
Sending money costs a fee, and you pay that fee. The fee is charged by Stripe and the bank networks, not by us. Before you confirm a withdrawal, we show each fee on its own line, the total fee and the amount you will receive. We take the fee from the amount we send.
Some payouts, such as international bank wires (SWIFT), carry a fixed fee for each withdrawal whatever its size, plus a currency conversion fee that is a share of the amount. A larger withdrawal makes the fixed fee a smaller share of it. You decide how much to withdraw and when, and you bear the fee.
The fee we show is Stripe’s estimate for that payout, and we take that amount when you ask to withdraw. The final fee is set when we send the payout. If it is different, we add the difference to your balance or take it from your balance, as a fee adjustment, and your history shows it. If we cannot get an estimate from Stripe, the screen says so and we estimate from our own fee table.
If the bank sends a payout back, for example because the account details were wrong, we credit the money back to your balance minus the payout fee. The fee we take is the final fee, set when we sent the payout. Your history shows the return and the fee. Fix your bank details before you try again.
Countries
We pay cash only in countries where Stripe Global Payouts can send money to a person’s bank account from the United States. The list is long and it changes. Your dashboard says whether cash is open for you.
In every other country you can still earn. You can convert your earnings to Creatide credits, but you cannot withdraw cash.
Some places are under a US embargo or comprehensive sanctions: Cuba, Iran, North Korea, Syria, and the Crimea (including Sevastopol), Donetsk and Luhansk regions, and other places we treat the same way, such as Russia, Belarus, Venezuela and Myanmar. There you can convert earnings to credits, but you can never withdraw cash.
A valid tax form decides your country. The country you signed up from is used only when you have no form. Both the country you declare and the country of your address on the form must be countries where we pay cash.
If you sign a tax form from an IP address in an embargoed place, you get no cash, only credits. A new form signed from a clean IP address opens cash.
We can change these country rules, for example when the law or Stripe’s coverage changes.
Tax forms and taxes
Before your first cash withdrawal, you fill in a US tax form, once. Use Form W-9 if you are a US person. Use Form W-8BEN if you are not. You sign it online on Creatide AI, and we keep a copy. Your tax ID is stored encrypted.
Give true information. If it changes, or if the form expires, we ask for a new one. Until then, cash is closed.
On Form W-9 you may say that you are subject to backup withholding. If you do, we keep your form, but cash is closed for you. You can still convert earnings to credits.
If you are a US person, we will report your cash withdrawals to the IRS on Form 1099-NEC when the law requires it. Today we report cash withdrawals only, not conversions to credits.
You are responsible for the taxes on everything you earn, including earnings you convert to credits. We do not give tax advice.
Identity and sanctions checks
Before your first conversion or withdrawal, we ask for your date of birth, once. We ask for your full legal name only if your account has no usable full name. Give your real legal name. One word is not enough.
The first date of birth you give is fixed, and we refuse a different one later. A legal name, once given, cannot be changed. If you made a mistake, ask Support.
We check your name against US sanctions lists (OFAC) when you first earn, and again before every conversion and every withdrawal.
A check can find a possible match. Then a person looks at it. Until we decide, conversions and withdrawals stay closed. If your name matches a sanctions list, you get neither cash nor credits.
We can refuse an account or a payment, and we can suspend an account, if a check fails, if the information looks false, or if the law requires it.
If the sanctions list is out of date or a check cannot run, we pause conversions and withdrawals until it can.
What is not allowed
You must not:
- buy through your own link, or sign up an account you control through it;
- make fake or duplicate accounts, or pay or trick people into signing up;
- run paid ads that bid on Creatide, Creatide AI or similar brand names, or use a domain that looks like ours;
- send spam or unwanted messages, or post your link where it is not welcome;
- force or hide clicks, for example cookie stuffing, hidden frames, or setting your link without a real click;
- make false or misleading claims about Creatide AI, its prices, what it can do, or what you can earn;
- write fake reviews or fake testimonials;
- pretend to be Creatide AI or to speak for us;
- get around the rule that a promo code and an affiliate link cannot be used together;
- break the law or our Terms of Service.
If you break these rules, we can suspend or close your affiliate account, reverse the commission you earned from the breach, and refuse a withdrawal.
Telling people you are an affiliate
In the United States, the Federal Trade Commission (FTC) requires you to say clearly that you earn a commission when you share your link.
In Turkey, the Advertising Board (Reklam Kurulu) influencer guide requires paid or partnered posts to be clearly marked as advertising.
Follow the rules of the country where your audience is, too.
Privacy
We do not show you who your customers are. Your dashboard shows the product, the date and the commission, and never a name, an email or an account. Do not try to find out.
We use your name, date of birth, country, tax form and payout details to run the program and to meet the law. Your bank details are entered in a form that Stripe hosts. Our Privacy Policy covers the rest.
When you sign a tax form, we record the IP address you sign from, the time, and the country of that IP address. That can affect whether cash is open to you.
When someone opens your link, we store a cookie and record the click, the device and the network address, so that we can match the sign-up to you. See our Cookie Policy.
Suspension and ending
You can stop at any time by no longer sharing your link. Your customers’ windows keep running, and you keep what is Available, under these terms.
We can suspend or close your affiliate account if you break these terms, if the law requires it, or if your Creatide account is banned. A match on a sanctions check that we block also suspends the account.
While your account is suspended, your link does not work, and you cannot convert or withdraw. A withdrawal that was approved goes back to review. Payments made in that time earn no commission, and we do not add it later.
We can end the program. If we do, we tell you how you can use your balance.
Changes to these terms
We can change these terms. The “Last updated” date at the top of this page is the date of the latest change.
When you accept, we store the version you accepted and the time you accepted it.
If we change the terms in a way that matters, we tell you before the change takes effect. If a change needs your acceptance again, we ask you, as described under “Who these terms are between”.
A change to a rate is not a change to these terms. It applies only to payments made after the change.
Liability
We provide the program “as is”. We do not promise that you will earn anything, that Creatide AI will always be available, or that every click will be tracked.
As far as the law allows, we are not liable for indirect losses or lost profits. Our total liability to you for the program is limited to the greater of the commission we paid you in the 12 months before the claim, or $100.
Nothing here limits a liability that the law does not let us limit.
Governing law and contact
These terms are governed by the laws of the State of Delaware and the United States.
Questions about the program: Support or support@creatide.ai. Legal notices: AIVID, LLC, 131 Continental Dr Suite 305, Newark, DE 19713, USA.
If a part of these terms cannot be enforced, the rest still applies.
