Overview

AIVID, LLC (“Company”, “we”, “us”, or “our”) operates Creatide AI. We respect intellectual property rights and comply with the U.S. Digital Millennium Copyright Act (17 U.S.C. §512). This DMCA Policy explains how to send a notice of claimed copyright infringement to our Designated Agent, how users can send a counter-notice, and how we handle both.

This DMCA Policy forms part of our Terms of Service. Terms defined there, such as “Service”, “Content”, and “Generated Content”, have the same meaning here.

What this policy covers

This policy covers material generated, uploaded, or hosted through Creatide AI, including:

  • inputs users provide, such as prompts, images, videos, and audio;
  • Generated Content created with the Service;
  • any other material displayed on the Service.

This policy covers copyright only. For trademark and other rights, see “Trademarks and other rights” below.

How to send a DMCA notice

Notice requirements (17 U.S.C. §512(c)(3))

If you believe material on Creatide AI infringes your copyright, send a written notice to our Designated Agent (see “Where to send it”). Your notice must include all of the following:

  1. Signature of the copyright owner or a person authorized to act on their behalf (physical or electronic).
  2. Identification of the copyrighted work claimed to have been infringed or, if one notice covers several works, a representative list of them.
  3. Identification of the material claimed to be infringing, and information reasonably sufficient to permit us to locate it (e.g., exact URL(s), Creatide AI project ID, timestamps, screenshots).
  4. Contact information: your name, mailing address, telephone number, and email address.
  5. Good-faith statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf.

If a notice is missing required information, we may ask you for it. We may not be able to act on a notice that does not substantially meet these requirements.

You can use this process wherever you are located. Laws outside the United States may give you other rights, and this policy does not limit them.

Where to send it

Designated DMCA Agent

Send DMCA notices and counter-notices to our Designated Agent:

Creatide AI DMCA Agent

AIVID, LLC

131 Continental Dr Suite 305

Newark, DE 19713, USA

Email: [email protected]

Subject line: “DMCA Notice – Creatide AI”

Send notices to the Designated Agent by email or by post. Messages sent through our support chat, Telegram, or community channels do not reach the Designated Agent and are not treated as DMCA notices.

What happens next

When we receive a notice:

  • We check whether it is complete under 17 U.S.C. §512(c)(3). If it is not, we may ask you for more information.
  • If it is complete, we expeditiously remove or disable access to the material and notify the user who posted or created it.
  • We may send that user a copy of the notice, or a summary of it, which may include your name and contact details, so that they can respond.
  • We keep a record of the notice and apply our repeat infringer policy where appropriate.

Counter-notice

Counter-notice requirements (17 U.S.C. §512(g)(3))

If material you posted or created was removed or disabled and you believe this happened because of a mistake or misidentification, you may send a counter-notice to our Designated Agent. It must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location (URL) where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.

When we receive a valid counter-notice, we promptly send a copy of it to the person who sent the original notice and tell them that the material may be restored in 10 business days. The copy includes the name and contact details in your counter-notice.

We may restore the material, or stop disabling access to it, no sooner than 10 and no later than 14 business days after we receive the counter-notice. We will not restore it if, before then, our Designated Agent receives notice from the person who sent the original notice that they have filed a court action seeking to restrain you from infringing activity relating to the material.

Repeat infringer policy

We terminate, in appropriate circumstances, the accounts of users we determine to be repeat infringers. We may also suspend accounts or limit access to features. We accommodate and do not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as required by 17 U.S.C. §512(i).

Separately from this process, we may remove content and suspend or terminate accounts under our Terms of Service when content violates them, including by infringing the rights of others.

AI-generated content

You are responsible for the inputs you provide, such as prompts and reference files, and for how you use Generated Content. Do not upload material you do not have the rights to use. Do not use the Service to create content that infringes the rights of others, such as outputs that copy a specific protected work, character, or logo. See our Terms of Service and Content Safety policy.

Generated Content is handled under this policy like any other material. If Generated Content on Creatide AI infringes your copyright, you can report it using the steps above.

False or abusive claims

Under 17 U.S.C. §512(f), anyone who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.

We may reject fraudulent, incomplete, or abusive notices and counter-notices, and we reserve the right to seek costs or damages for knowing material misrepresentations under §512(f).

Nothing on this page is legal advice. If you are not sure whether material infringes your rights (for example, because the use may be permitted by law), consider speaking with a lawyer before you send a notice.

Trademarks and other rights

This policy covers copyright only. To report trademark, privacy, likeness, or other rights concerns about content on Creatide AI, contact Support or email [email protected] with the details and a link to the material. We handle these reports under our Terms of Service and Content Safety policy, not under the DMCA process.

Changes to this policy

We may update this policy from time to time. Because it forms part of our Terms of Service, changes follow the “Modifications to the Terms” section of the Terms: we update the “Last updated” date at the top of this page and may notify users where appropriate.
